Oh my goodness. Jennifer Hudson and her fiancé David Otunga have reached a temporary custody agreement — and David will have primary custody of their eight-year-old son David Jr.

According to TMZ, the former couple agreed to the custody arrangement as Jennifer is currently living in London while filming The Voice UK and traveling frequently for the U.S. version of the reality dating competition. Recently, their unexpected split took a very dark turn when The Blast reported that David had allegedly been getting more angry and extreme, and JHud granted a protective order against the former wrestler, which she later dropped.

After their split went public, Jennifer, 36, revealed that David, 37, had been threatening to take her son away, and she feared he may leave the state without telling her. “The frequency and intensity of David’s conduct has escalated to the point that I am now living in fear for my physical and emotional safety and that of my son,” she wrote in court documents. David had allegedly been scaring David Jr., so he’s afraid to even spend time with his mother. She alleged that David Jr. cried in the studio with her recently because “he was fearful of the consequences his father might impose on him for just being there.”

This shocking news came just days after Jennifer’s rep confirmed that they called off their engagement. “They have been in the process of ending their relationship for a number of months. Today, Jennifer requested and received a protective order against her ex-fiancé. Jennifer’s actions are solely taken in the best interest of their son.” It was originally unclear why the Voice judge felt that her son needed protection from his father, but now it’s becoming more clear.

It makes sense why Jennifer would be so worried after the tragedy her family was involved in 2008. Jennifer’s sister’s estranged husband murdered her mother, brother, and nephew, so we don’t blame her for being extra-careful with these types of things.

The drama explains why Jennifer has been so sensitive about joking about her personal life with her fellow judges on The Voice. Life & Style learned exclusively that Jen got into a spat with Miley Cyrus after the popstar brought up her husband recently. Toward the end of October, Miley joked about Jennifer still not being married after a nine-year engagement, and Jen freaked. “She looked Miley right in the eye and told her to never mention her private life again, or even say David’s name,” a source told us. At the time the source said that Jennifer just isn’t the type to joke around, but now it’s possible that she was already having relationship issues and didn’t want to talk about it.
